OVERVIEW

Welcome to City of The Saints! The terms "we", "us" and "our" refer to City of The Saints. City of The Saints operates this website and online store, including all related information, content, features, tools, products and services in order to provide you, the customer, with an online event ticketing and curated community experience (the "Services"). City of The Saints is powered by Shopify, which enables us to provide the Services to you.

The below terms and conditions, together with any policies referenced herein (these "Terms of Service" or "Terms") describe your rights and responsibilities when you use the Services and purchase tickets to our events.

Please read these Terms of Service carefully, as they include important information about your legal rights and cover areas such as admission policies, cancellation rules, warranty disclaimers, and limitations of liability.

By visiting, interacting with or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms of Service or Privacy Policy, you should not use or access our Services.

SECTION 1 - ACCESS AND ACCOUNT

By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence, and you have given us your consent to allow any of your minor dependents to use the Services.

To purchase event tickets, you will be asked to provide certain information, such as your email address, phone number, name, and billing information. You represent and warrant that all the information you provide is correct, current and complete and that you have all rights necessary to provide this information.

You are solely responsible for maintaining the security of your account credentials and for all activity associated with your ticket purchases. Tickets may not be resold for a premium or commercial gain without our express prior written consent.

SECTION 2 - EVENT DESCRIPTIONS AND ADMISSION

We make every effort to provide accurate details regarding our events, including dates, times, venues, themes, and lineups. However, event schedules, performance line-ups, and specific venue spaces within a location are subject to change without prior notice.

Age Restrictions & Identification: Many of our events have strict age requirements (e.g., 18+ or 21+). It is your sole responsibility to check the specific event page details prior to purchasing. To gain admission to the venue, you must present a valid, government-issued photo ID matching the age requirements of the event alongside your digital ticket. No refunds or exchanges will be provided if you are denied entry by security due to a failure to meet age requirements or lack of valid ID.

SECTION 3 - TICKETS, ORDERS, AND CANCELLATIONS

When you place an order for a ticket, you are making an offer to purchase. City of The Saints reserves the right to accept or decline your order for any reason at its discretion. Your order is not accepted until City of The Saints confirms acceptance via an order confirmation email. We must receive and process your payment before your order is accepted and tickets are generated.

All Sales Are Final: Except as explicitly outlined in Section 5 (Event Cancellation & Rescheduling), all ticket purchases, including early bird, general admission, and group ticket bundles, are completely non-refundable and cannot be exchanged.

You represent and warrant that your ticket purchases are for your own personal or household use and not for commercial resale, bulk brokering, or unauthorized distribution.

SECTION 4 - PRICES AND BILLING

Prices, tier availability (such as Early Bird vs. General Admission), discounts, and promotions are subject to change without notice. The price charged for an event ticket will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include applicable local taxes or processing fees.

You agree to provide current, complete, and accurate purchase, payment, and billing information for all transactions. You represent and warrant that (i) the credit card or payment information you provide is true, correct, and complete, (ii) you are duly authorized to use such payment method, and (iii) you will pay all charges incurred by you at the posted prices, including all applicable taxes and processing fees.

SECTION 5 - DIGITAL DELIVERY, ENTRY, AND RESCHEDULING

Digital Ticket Delivery: City of The Saints does not ship physical goods or paper tickets. All tickets purchased through the online store are delivered digitally via the email address or SMS text phone number provided at the time of checkout. If you do not receive your digital ticket within 24 hours of purchase, it is your responsibility to contact us at bookings@cityofthesaints.com.

Venue Entry: You must present a scannable digital barcode, ticket confirmation screen, or authorized printed copy of your digital ticket at the venue entrance to gain access. We are not responsible for tickets that cannot be retrieved due to customer device malfunctions, low battery, or lack of internet connectivity at the venue.

Postponements, Changes, and Cancellations:

If an event is postponed or rescheduled to a different date or significantly different venue location, your digital ticket will automatically remain valid for the new date/venue.
If an event is completely canceled by City of The Saints without a rescheduled date, a full refund of the face value of the ticket will be issued to the original payment method used at checkout. We are not liable for any personal travel, lodging, or secondary accommodations booked by attendees in connection with a canceled or postponed event.

SECTION 6 - INTELLECTUAL PROPERTY

Our Services, including but not limited to all trademarks, brands, event names, layout text, displays, images, promotional graphics, event videos, audio, and the selection and arrangement thereof, are owned by City of The Saints, its affiliates or licensors and are protected by Canadian, U.S., and foreign copyright and intellectual property laws.

You must not reproduce, distribute, modify, create derivative works of, publicly display, or transmit any of the material on our Services without our prior written consent. City of The Saints' names, logos, event titles, designs, and slogans are trademarks of City of The Saints. Shopify's name and logo are trademarks of Shopify. All other trademarks appearing on the site belong to their respective owners.

SECTION 7 - OPTIONAL TOOLS AND THIRD-PARTY LINKS

We may provide you with access to third-party tools (such as digital map integrations or third-party ticketing widgets) and hyperlinks to external websites which we do not monitor or control.

You acknowledge and agree that we provide access to such tools and links "as is" and "as available" without any warranties or endorsements. We assume no liability whatsoever arising from or relating to your use of optional third-party tools or your interaction with third-party sites. Please review the third-party's policies carefully before engaging in any external transactions.

SECTION 8 - RELATIONSHIP WITH SHOPIFY

City of The Saints is powered by Shopify, which provides the online hosting infrastructure enabling us to sell digital event tickets to you. However, all sales and ticket transactions are made directly between you and City of The Saints. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of the sales transactions, event execution, venue conditions, or any injury, damage, or loss resulting from attending an event. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your ticket transactions with City of The Saints.

SECTION 10 - PRIVACY POLICY

All personal information we collect through the Services is subject to our Privacy Policy, and certain checkout processing data may be subject to Shopify's Privacy Policy. By purchasing a ticket or using the Services, you acknowledge that you have read these privacy policies.

Because the Services are hosted by Shopify, Shopify collects and processes personal information about your access to and use of the Services in order to securely process payments and generate digital tickets. Information you submit to the Services will be transmitted to and shared with Shopify as well as third parties that may be located in other countries than where you reside, in order to complete ticketing services for you.

SECTION 11 - ATTENDEE CONDUCT AND VENUE RULES

By purchasing a ticket, you agree to comply with all rules and regulations of the venue where the event is hosted, as well as all instructions from event staff, security personnel, and local authorities.

City of The Saints and the venue management reserve the right, without refund of any amount paid, to refuse admission to, or eject, any person whose conduct management deems disorderly, abusive, unsafe, or who fails to comply with venue regulations.

SECTION 12 - ERRORS, INACCURACIES, AND OMISSIONS

Occasionally there may be information on our site that contains typographical errors, inaccuracies, or omissions that may relate to event descriptions, tier pricing, ticket availability, venue details, or promotional offers. We reserve the right to correct any errors, inaccuracies, or omissions, and to change or update information or cancel ticket orders if any information is inaccurate at any time without prior notice (including after you have submitted your order).

SECTION 13 - PROHIBITED USES

You may access and use the Services for lawful purposes only. You may not use the Services, directly or indirectly: (a) for any unlawful purpose; (b) to violate any international, federal, provincial, or local regulations, rules, or laws; (c) to infringe upon or violate our intellectual property rights or the rights of others; (d) to transmit false, fraudulent, or misleading information; (e) to attempt to duplicate, forge, or alter digital ticket barcodes; (f) to use any automated robot, spider, scraping tool, or manual process to extract data or aggressively crawl ticket inventories; or (g) to circumvent or bypass security measures, CAPTCHAs, or authorization features implemented on the site. We reserve the right to cancel your tickets and ban your account immediately if you violate any of these terms.

SECTION 14 - TERMINATION

We may terminate this agreement or suspend your access to the Services (or any part thereof) in our sole discretion at any time without notice. Provisions that by their nature should survive termination shall continue to apply, including Intellectual Property, Ticket Order Policies, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law.

SECTION 15 - DISCLAIMER OF WARRANTIES

EXCEPT AS EXPRESSLY STATED BY CITY OF THE SAINTS, THE SERVICES AND ALL EVENT TICKETS SOLD THROUGH THE SERVICES ARE PROVIDED 'AS IS' AND 'AS AVAILABLE' FOR YOUR USE, WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT GUARANTEE, REPRESENT, OR WARRANT THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.

SECTION 16 - LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PROVIDED BY LAW, IN NO CASE SHALL CITY OF THE SAINTS, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, CONTRACTORS, SERVICE PROVIDERS, OR LICENSORS, OR THOSE OF SHOPIFY AND ITS AFFILIATES, BE LIABLE FOR ANY INJURY, LOSS, CLAIM, OR ANY DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING, WITHOUT LIMITATION, PERSONAL INJURY, PROPERTY DAMAGE, LOSS OF DATA, OR ANY SIMILAR DAMAGES ARISING FROM YOUR ATTENDANCE AT ANY OF OUR EVENTS OR PROCURING DIGITAL TICKETS USING THE SERVICES.

SECTION 17 - INDEMNIFICATION

You agree to indemnify, defend and hold harmless City of The Saints, Shopify, and our affiliates, partners, officers, directors, employees, agents, contractors, licensors, and service providers from any losses, damages, liabilities or claims, including reasonable attorneys' fees, made by any third party due to or arising out of (1) your breach of these Terms of Service, (2) your violation of any law or the rights of a third party, or (3) your conduct at an event hosted by City of The Saints.

SECTION 18 - SEVERABILITY & WAIVER

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions. The failure of us to enforce any right or provision shall not constitute a waiver of such right.

SECTION 19 - GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of the Province of Manitoba and the federal laws of Canada applicable therein. You and City of The Saints consent to the exclusive venue and jurisdiction of the provincial and federal courts located in Winnipeg, Manitoba, Canada.

You can review the most current version of the Terms of Service at any time on this page. We reserve the right, in our sole discretion, to update, change, or replace any part of these Terms by posting updates and changes to our website. Your continued use of or access to the Services following the posting of any changes constitutes acceptance of those changes.
